What Is Equitable Distribution of Property?
In New York, property is not divided equally. It is divided equitably, or fairly. In other words, property is not automatically split 50/50, although that is a potential outcome if it is deemed fair. However, it could also be divided in some other manner. Property division will be based on the incomes of each spouse and other factors.
The challenge is that fairness is very subjective. What seems fair to one side may not seem fair to the other. This is why it is so critical to have an experienced lawyer on your side. Our role is to make it clear that what you believe is fair is, in actuality, the fair outcome.
